Reservation and payment:
a. The villa reservation will be confirmed as soon as the renter has paid a deposit of 30% of the total amount via bank transfer. b. The remaining balance of 70% must be received by the landlord no later than 6 weeks before the arrival date. If this amount is not received on time, the reservation will automatically be canceled, and the deposit will remain fully due as a cancellation fee, regardless of the cancellation periods listed below.
b. The remaining amount must be paid according to the agreed payment terms, prior to the arrival date.
Cancellation:
a. Guests can cancel their reservation free of charge and receive a full refund if they do so at least 30 days before the scheduled arrival date.
b. For cancellations made between 7 and 30 days before the arrival date, the guest will receive a 50% refund of the total stay cost.
c. For cancellations made within 7 days of the arrival date, no refund will be provided. The full stay cost remains due.
d. If a guest cancels within 48 hours of making the booking, they will receive a full refund, provided the booking was made at least 14 days before the check-in date.
e. Cancellations can only be made in writing (by email); the date on which we receive the cancellation shall be deemed the cancellation date.
f. These cancellation periods (a through d) apply to cancellations by the tenant. In the event of late payment of the remaining amount as referred to under “Reservation and payment”, the deposit shall remain fully due at all times, regardless of the above periods.
Arrival and departure:
Upon arrival, a security deposit will be reserved on the renter's credit card via a pin terminal (pre-authorization, no charge). If no damage or additional costs are found upon departure, the deposit will be fully released within 14 days of departure. In the event of damage or additional costs, the lessor reserves the right to withhold (part of) the deposit.*¹
Use of the villa:
a. The villa may only be used for vacation or recreational purposes, unless otherwise agreed in writing with the landlord.
b. It is prohibited to use the villa for illegal activities, cause disturbances, or disrupt the peace of the surrounding area.
Responsibilities of the tenant:
a. The tenant is responsible for the villa and its inventory during the rental period and will treat them with care.
b. Any damage to the villa or inventory must be reported to the landlord immediately.
Responsibilities of the landlord:
a. The landlord will ensure that the villa is in good condition and meets the required safety standards.
b. The landlord is not liable for any inconveniences, disruptions, or disturbances caused by third parties, such as public utilities or construction work in the surrounding area.
Liability:
a. The landlord is not liable for personal injury, theft, or damage to the tenant's property during the stay at the villa.
b. The tenant is advised to take out appropriate travel insurance that covers such eventualities.
Disputes:
a. Any disputes between the landlord and the tenant regarding these terms and conditions or the rental agreement will primarily be resolved through negotiations and good faith.
b. If a dispute cannot be resolved amicably, it will be submitted to the competent courts of the jurisdiction in which the villa is located.
Applicable law:
a. These terms and conditions and the rental agreement are governed by the laws of Spain.
b. In case of any discrepancy between the Dutch translation of these terms and conditions and the original Spanish version, the Spanish version will be considered authoritative.
Other provisions:
a. Any changes or additions to these terms and conditions must be agreed upon in writing between the landlord and the tenant.
b. If any provision of these terms and conditions is declared invalid or unenforceable, the remaining provisions will remain in full force and effect.
By signing the rental agreement, the tenant agrees to these terms and conditions and the obligations and provisions contained therein regarding the rental of the villa in Spain.
