Terms and Conditions
Reservation and payment:
a. The reservation of the villa is confirmed once the tenant has made a deposit, as agreed upon between the landlord and the tenant.
b. The remaining amount must be paid according to the agreed payment terms, prior to the arrival date.
Cancellation:
a. Guests can cancel their reservation free of charge and receive a full refund if they do so at least 30 days before the scheduled arrival date.
b. For cancellations made between 7 and 30 days before the arrival date, the guest will receive a 50% refund of the total stay cost.
c. For cancellations made within 7 days of the arrival date, no refund will be provided. The full stay cost remains due.
d. If a guest cancels within 48 hours of making the booking, they will receive a full refund, provided the booking was made at least 14 days before the arrival date.
Arrival and departure:
a. The tenant must respect the arrival and departure times, unless otherwise agreed upon with the landlord.
b. Upon arrival, the tenant will pay a security deposit, which will be refunded after inspection of the villa, minus any damage or additional costs.*¹
Use of the villa:
a. The villa may only be used for vacation or recreational purposes, unless otherwise agreed in writing with the landlord.
b. It is prohibited to use the villa for illegal activities, cause disturbances, or disrupt the peace of the surrounding area.
Responsibilities of the tenant:
a. The tenant is responsible for the villa and its inventory during the rental period and will treat them with care.
b. Any damage to the villa or inventory must be reported to the landlord immediately.
Responsibilities of the landlord:
a. The landlord will ensure that the villa is in good condition and meets the required safety standards.
b. The landlord is not liable for any inconveniences, disruptions, or disturbances caused by third parties, such as public utilities or construction work in the surrounding area.
Liability:
a. The landlord is not liable for personal injury, theft, or damage to the tenant's property during the stay at the villa.
b. The tenant is advised to take out appropriate travel insurance that covers such eventualities.
Disputes:
a. Any disputes between the landlord and the tenant regarding these terms and conditions or the rental agreement will primarily be resolved through negotiations and good faith.
b. If a dispute cannot be resolved amicably, it will be submitted to the competent courts of the jurisdiction in which the villa is located.
Applicable law:
a. These terms and conditions and the rental agreement are governed by the laws of Spain.
b. In case of any discrepancy between the Dutch translation of these terms and conditions and the original Spanish version, the Spanish version will be considered authoritative.
Other provisions:
a. Any changes or additions to these terms and conditions must be agreed upon in writing between the landlord and the tenant.
b. If any provision of these terms and conditions is declared invalid or unenforceable, the remaining provisions will remain in full force and effect.
By signing the rental agreement, the tenant agrees to these terms and conditions and the obligations and provisions contained therein regarding the rental of the villa in Spain.
